1. Acceptance of Terms

By accessing and using VinoMemo ("the Service"), you accept and agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

We reserve the right to update these Terms at any time. We will notify you of material changes via email or in-app notification. Your continued use of the Service after such changes constitutes acceptance of the updated Terms.

2. Description of Service

VinoMemo is a wine tasting notes application that helps you create, store, and manage professional wine tasting notes using the WSET (Wine & Spirit Education Trust) systematic approach.

The Service includes:

• Free WSET Level 2 framework for all users
• Optional WSET Level 3 unlock (one-time purchase)
• Cloud storage and synchronization of wine notes
• Cross-platform access (web and mobile)
• Export functionality for your data
• Optional Tip Jar for supporting development

3. Account Responsibilities

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use of your account
• Ensuring your account information (email address) is accurate and up-to-date

You must be at least 17 years old to use this Service, as it involves content related to alcoholic beverages.

4. In-App Purchases and Payments

WSET Level 3 Unlock

• One-time purchase of $9.99 USD (or equivalent in your currency)
• Non-consumable purchase - pay once, keep forever
• Unlocks advanced WSET Level 3 features including enhanced intensity scales, development assessments, and clarity analysis
• Tied to your account - accessible on all devices where you sign in
• No recurring subscription charges

Tip Jar

• Optional voluntary contributions ($0.99, $2.99, $4.99 USD)
• Consumable purchases - support development and improvements
• No features are locked behind tips - this is purely voluntary support
• Tips help fund continued development and server costs

Payment Processing

All payments are processed by Apple App Store or Google Play Store. We do not have access to your payment information. Refunds are subject to the respective app store's refund policies.

5. Future Features and Pricing

VinoMemo may introduce optional premium features, subscriptions, or in-app purchases in the future. Any features available at the time you create your account will continue to be available to you at no additional cost. New features introduced after your account creation may be offered as optional premium features.

We reserve the right to:

• Add optional premium features or tiers
• Introduce subscription options for new functionality
• Offer in-app purchases for additional capabilities

We will provide advance notice of any significant changes through in-app notifications and updated Terms of Service. Existing users will be grandfathered into features available at the time of their account creation.

6. Prohibited Uses

You agree NOT to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorized access to the Service or other user's accounts
• Upload malicious code, viruses, or harmful content
• Violate any applicable local, state, national, or international law
• Scrape, spider, or harvest data from the Service using automated tools
• Reverse engineer, decompile, or disassemble any part of the Service
• Impersonate another person or entity, or falsely represent your affiliation
• Interfere with or disrupt the Service or servers or networks connected to the Service

7. WSET Trademark Notice

WSET® is a registered trademark of the Wine & Spirit Education Trust. VinoMemo is an independent application and is not affiliated with, endorsed by, or sponsored by WSET.

The WSET systematic approach to wine tasting is used for educational purposes. This app is designed to help wine enthusiasts and WSET students practice professional wine analysis, but it is not an official WSET product.

8. Your Content and Data

You retain all rights to the wine tasting notes and content you create in VinoMemo ("Your Content"). By using the Service, you grant us a limited license to store, process, and display Your Content solely for the purpose of providing the Service to you.

We will not:

• Sell or share your wine notes with third parties
• Use your tasting data for advertising or marketing purposes
• Claim ownership of your content

You are responsible for backing up your data. We provide export functionality to download your notes as CSV files. While we make regular backups, we recommend you periodically export your data for safekeeping.

9. Service Availability and Modifications

We strive to provide reliable, uninterrupted service, but we cannot guarantee that the Service will be available at all times. The Service may be temporarily unavailable due to:

• Scheduled maintenance and updates
• Emergency maintenance or repairs
• Technical issues beyond our control
• Force majeure events

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice. We will make reasonable efforts to notify users of significant changes.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VINOMEMO AND ITS DEVELOPERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee that the Service will be error-free, secure, or uninterrupted. You use the Service at your own risk.

11. Indemnification

You agree to indemnify and hold harmless VinoMemo, its developers, and affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any rights of another party
• Your Content

12. Data Export and Account Deletion

You have the right to:

• Export your data: Download all your wine notes as CSV files at any time through Settings → Export Notes
• Delete your account: Request permanent account deletion by contacting us via the contact page

When you delete your account, all your personal data and wine notes will be permanently removed from our servers within 30 days. This action is irreversible.

13. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of France, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the Service shall be resolved through good faith negotiations. If a resolution cannot be reached, disputes will be subject to the exclusive jurisdiction of the courts of France.

14. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to be valid and enforceable to the fullest extent permitted by law.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and VinoMemo regarding the use of the Service.
