2. General Terms of Use

Purpose of the service

VinoMemo lets you create, organize, and retrieve wine tasting notes.

Without an account, the Local Library stores notes and photos on your device. Optional Backup & Syncrequires a VinoMemo account and synchronizes notes and photos between your devices.

VinoMemo does not sell alcohol. Age classifications shown by app stores describe their own content rating; they do not create a contractual age requirement for using VinoMemo.

One-time in-app purchases

VinoMemo does not offer subscriptions.

The non-consumable Advanced purchase unlocks the features described in the store.

Purchases are linked to the Apple or Google account used in the store. They do not require a VinoMemo account.

For an App Store purchase, Apple Distribution International Ltd. acts as the store's merchant of record. For a Google Play purchase, Google Commerce Limited acts as the store's merchant of record. The store displays the price and handles payment, taxes, the receipt, withdrawal requests, and refunds under its own terms.

VinoMemo remains the application's licensor and the provider of Backup & Sync.

Withdrawal

For a distance purchase, consumers generally have fourteen days to withdraw. You must submit the request to the store used for the purchase under the applicable Apple or Google procedure.

For digital content supplied immediately, loss of the withdrawal right requires performance to have begun after the consumer's prior express consent and express waiver of that right. The information and choices shown by the store at the time of purchase determine whether this exception applies.

Statutory conformity guarantee

Digital content and services benefit from the statutory conformity guarantee under the French Consumer Code. This guarantee covers, in particular, conformity with the description, expected operation, and updates required to maintain conformity.

Consumers may request that the content or service be brought into conformity at no cost. If bringing it into conformity is impossible, refused, delayed, or causes a major inconvenience, they may use the other remedies provided by law.

For a store purchase, consumers may contact Apple or Google as the seller of the transaction. They may contact VinoMemo at contact@vinomemo.app about a defect in the application, its licence, or Backup & Sync.

Complaints and consumer mediation

Consumers must first send their complaint to contact@vinomemo.app.

After an attempt at amicable resolution that does not produce a satisfactory response, they may refer the matter free of charge to VinoMemo's consumer mediator:

La Société Médiation Professionnelle
Alteritae, 5 rue Salvaing, 12000 Rodez, France
https://www.mediateur-consommation-smp.fr

The request must meet the admissibility conditions published by the mediator and the time limits set by the French Consumer Code.
